HOW TO BID ONLINE:

TERMS & CONDITONS 

I. GENERAL:

BIDDING:  By placing a bid, you are entering into a legally binding contract with Damon Shortt Real Estate & Auction Group.  If you are the successful and winning bidder, you are legally obligated to purchase the property (real or personal).  The successful bidder must pay for the entire invoice.  Furthermore, by placing a bid, bidder acknowledges that he/she has read, understood and agrees to be bound the terms and conditions as set forth herewith.

REGISTRATION:  Bidders must register online to place a bid.  You will be required to provide your credit card information when you register.  You can pre-register online anytime prior to the start of the auction.  Visit our website at DAMONSHORTTPROPERTIES.COM and click on the auction you want to register for.  Click on the link to register online where you can then register as a new bidder or enter your log in information.

CREDIT CARD VERIFICATION:   When you register to bid, you will undergo credit card verification.  Your card will not be charged unless you are the winning bidder.

BUYER’S PREMIUM:  The buyer’s premium will be added to your highest bid and become part of the total purchase price.  The amount of the buyer’s premium will be specified on the particular auction you want to register and bid on.

FORMS OF PAYMENT:  Payment by credit card, wire transfer, check or certified check are accepted.  A 2% credit card fee will be added for any credit card payments.  A $10 fee will be added for any wire transfer.

DISCLAIMER: This property is being sold “As-Is, Where Is” without warranty or guarantee.  Information posted on our website or any other online platform or newspaper ads was taken from sources believed to be correct.  No information contained in said postings or ads shall be deemed as warranty, guarantee or representation by the Auction Company.  Damon Shortt Real Estate & Auction Group will not be liable for any errors or omissions, in the event that the description of the property (real estate or personal property) is mistakenly advertised.  Buyer is responsible for examining and determining the condition and quality of the property (real estate or personal property) and acknowledges that they are buying it “As Is.”  Damon Shortt Real Estate & Auction Group is not responsible for any failure of internet service due to power outage or work interruptions. Damon Shortt Real Estate & Auction Group is not responsible for any missed bids from any source.

RIGHT TO AMEND:  Damon Shortt Real Estate & Auction Group reserves the right to pull any or all of the property at any time prior to the property being offered on the auction block.

II. ADDITIONAL REAL ESTATE TERMS:

WINNING BIDDER ON REAL ESTATE AUCTIONS:  If you are the winning bidder, you will receive an email from Damon Shortt Real Estate & Auction Group with your bid information and you will be required to sign our standard Purchase Agreement.  You will be contacted by Damon Shortt Real Estate & Auction group to arrange for payment of the required down payment.  Payment may be made by credit card, wire transfer or certified check.  A 2% charge will be applied to any credit card payments.  A $10 fee will be added for any wire transfers.  PAYMENTS MUST BE RECEIVED WITHIN 48 HOURS AFTER THE CLOSE OF THE AUCTION.  The downpayment will be held in escrow by Damon Shortt Real Estate & Auction Group until closing.

DOWN PAYMENT FOR REAL ESTATE ONLINE AUCTION:  A down payment of 10% of the total purchase price (bid price plus buyer’s premium) is due within 24 hours after close of the auction. Balance is due in full at closing within 30 days from the day of the auction.

ADEQUATE FUNDS:  No purchase shall be contingent upon Buyer obtaining financing. In addition, no purchase shall be contingent upon Buyer conferring or transferring another property to obtain funds for the closing of this transaction. By placing a bid, Bidder acknowledges that they   have adequate funds or access to adequate funds to purchase the property.

“AS-IS”:  The property is being sold “As Is” without any warranty or guarantee by Damon Shortt Real Estate & Auction Group, its representatives, agents or employees.

DUE DILIGENCE:  Bidder acknowledges that they have performed their own due diligence prior to placing a bid.  Bidder further acknowledges that Damon Shortt Real Estate & Auction Group, its affiliates, employees, agents or representative does not perform any due diligence on any property listed for auction.  Bidder should satisfy themselves as to the condition, quality, and state of repair or lack of repair, habitability, structural integrity and/or fitness for particular purpose of the property offered at auction and by placing a bid, Bidder acknowledges that they are buying the property “As is.”

PURCHASE & SALE AGREEMENT:  The winning bidder is required to sign our standard Purchase Agreement the day of the auction via email, fax or in person.   The executed Agreement must be returned to Damon Shortt Real Estate & Auction Group the day of the auction.  The online terms and condition is incorporated into and is part of the Purchase and Sale Agreement.

TITLE TO REAL ESTATE:  Damon Shortt Real Estate & Auction Group does not make any warranty or guarantee about the status of the title of the property.

III. ADDITIONAL PERSONAL PROPERTY TERMS

PERSONAL PROPERTY PAYMENTS:  The winning bidder must pay the full invoice day of the auction before they can collect the items they bid on.  If you are the winning bidder, the credit card information you provided will be charged for the full invoice price (bid price plus buyer’s premium and taxes) immediately following the auction.  If you wish to pay by cash, check or money order, please contact us at (843) 669-4005 to let us know ahead of time so we do not charge your credit card.

“AS-IS”:  By placing a bid, Buyer acknowledges that they are buying the item “As Is” without any warranty or guarantee by Damon Shortt Real Estate & Auction Group, its representatives, agents or employees.

SHIPPING:  Small and easy to box items may be shipped at buyer’s expense via USPS Priority Mail.  There is a minimum of $20 shipping and handling fee which will be added to your invoice.  Items will not be shipped unless full payment is made.  Buyer is responsible for all shipping, packing and insurance costs.  Damon Shortt Real Estate & Auction Group is not responsible for any acts, omissions, or damage from shipping.

Bigger items must be picked up during the scheduled pick up times.

PICK UP SCHEDULE:  Items must be paid in full before they can be picked up.  You will need to bring our receipt when picking up items.  Pick up times will be posted on the specific auction listing.
